1. Acceptance of Terms

By accessing the digital retail and communication platform (the "Platform") operated by {{CUSTOMER}} ("Dealer", "we", "us"), you agree to these Terms of Service. This Platform is powered by Transax, Inc. ("Transax"). If you do not agree to these terms, please do not use the Platform.

2. SMS Messaging & Disclosure

By providing your mobile number, you give express consent to receive text messages from {{CUSTOMER}} regarding your inquiries, quotes, or active transactions.

Opt-In: Consent is obtained via web forms, text-to-join keywords, or verbal confirmation during an inquiry. Consent is not a condition of any purchase.
Usage: Messages include transactional updates, payment links, and quote details.
Cost: Message and data rates may apply.
Opt-Out: Text STOP at any time to unsubscribe. A confirmation message will be sent.

3. Role of Transax

Transax provides the software infrastructure. However, any transaction involving vehicles, parts, or services is strictly between you and {{CUSTOMER}}. Transax is not a party to any sales agreement and does not represent the Dealer or the Customer in any legal capacity regarding the physical goods sold.

4. Payments and Digital Signatures

You authorize {{CUSTOMER}} to process payments through the Platform using the methods provided.

E-Signatures: Digital signatures captured on this Platform are the legal equivalent of manual ink signatures.
Refunds: All refund policies are governed by the Dealer. As Transax does not hold transaction funds, all financial disputes must be resolved directly with {{CUSTOMER}}.

5. Privacy & Security

We value your privacy. Your data is handled according to our Privacy Policy. Important: Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

6. Limitation of Liability

To the maximum extent permitted by law, Transax, Inc. shall not be liable for any disputes, damages, or claims arising from the Dealer’s products or services. Your sole recourse for transaction-related issues lies with {{CUSTOMER}}.
